TERMS AND CONDITIONS

EFFECTIVE DATE May 16, 2023

OPERATIONAL TERMS

LAKES REGION MIRROR ME BOOTH agrees to have a photo booth operational for a minimum of 80% during the agreed upon time frame. Occasionally, operations may need to be interrupted for maintenance of the photo booth.

In the event LAKES REGION MIRROR ME BOOTH is unable to supply a working photo booth for at least 80% of the service period, CLIENT shall be refunded a prorated amount based on the amount of service received.

In the event the printer fails to print out photos on site that were part of the contracted package, LAKES REGION MIRROR ME BOOTH shall furnish a copy of all pictures via digital file and also mail 2 copies of each printout, free of charge, to CLIENT within 15 days of the event.

RETAINER AND FINAL PAYMENT

A $450 retainer is due upon signing the Rental Agreement and Service Contract. LAKES REGION MIRROR ME BOOTH will confirm event date has been RESERVED once the $450 retainer and a signed copy of the Rental Agreement and Service Contract has been received.

After the $450 retainer is paid, your remaining balance is due 21 days prior to the event date. Once final payment has been received, LAKES REGION MIRROR ME BOOTH will confirm the event date has been BOOKED. 

If CLIENT’S balance has not been collected by 21 days prior to the event date, LAKES REGION MIRROR ME BOOTH reserves the right to cancel services and NO refund will be given.

DAMAGE DEPOSIT/DAMAGE TO EQUIPMENT

A refundable DAMAGE DEPOSIT of $150 will be included in the final payment and will be returned within 15 days of the event if no theft or damage occurred.

CLIENT acknowledges that they shall be responsible for any damage or loss to LAKES REGION MIRROR ME BOOTH’S equipment caused by:  

Any misuse of the equipment by CLIENT or guests (invited or uninvited)

Any theft of props or equipment will be covered, in part, by DAMAGE DEPOSIT. If excessive damage or theft occurs, the CLIENTacknowledges responsibility and will make restitution

CLIENT acknowledges LAKES REGION MIRROR ME BOOTH shall have the right to decline service to CLIENT’S guests for misuse or unruly behavior

MODEL RELEASE & ONLINE PHOTO HOSTING

CLIENT agrees it is their responsibility to notify guests of the following LAKES REGION MIRROR ME BOOTH’S Model Release:

All persons using the photo booth hereby grant LAKES REGION MIRROR ME BOOTH the right and permission to copyright and use photographic portraits/pictures/video of any guest/photo booth user, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. 

In addition, CLIENT agrees to hereby release LAKES REGION MIRROR ME BOOTH from any liability that may occur or be produced in the taking of said portraits/pictures/video, or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.

LAKES REGION MIRROR ME BOOTH offers online photo hosting on our website so guests can share and download their favorite memories. LAKES REGION MIRROR ME BOOTH will not host any photos of events at schools, unless at a college or university. We reserve the right to photographer’s copyright, unless you specifically notify us in writing before your event date that you prefer us not use your event images.

VENUE REQUIREMENTS

CLIENT to communicate with the venue coordinator to arrange an appropriate space for the photo booth at the event’s venue, to include the following:

15’ x 15’ floor space

a solid floor

120V, 10 amp, 3 prong outlet from a reliable power source within 20 feet (along

a wall) of the set-up area. The circuit must be free of any other connections 

NO stairs to climb

wi-fi login and password

CLIENT is responsible for providing power for the photo booth. Any damage to the photo booth equipment due to improper power is the responsibility of the CLIENT. If there is any delay in performance due to power issues, NO refunds will be given.

The photo booth is approximately 200 lbs.  If the designated set up area is not on ground level, an elevator is mandatory.  If there is not an elevator, necessitating the use of stairs to access the designated set up area, will result in an additional charge of $350, which must be paid prior to climbing stairs and setting up. It is up to LAKES REGION MIRROR ME BOOTH to determine if climbing the stairs is a possibility. If there is a delay, or an event is cancelled the day of event due to stairs, NO refunds will be given. It is preferable for LAKES REGION MIRROR ME BOOTH to know about any stairs prior to the event date. Please share our contact information with the event coordinator and venue contact.

OUTDOOR VENUES

We hope that Mother Nature will grant you a perfect day for your outdoor event, however there is wisdom in having a "Plan B,” and we must have one. If you choose to place the photo booth outdoors, we must be in an area that:

is COMPLETELY dry

has SAFE access to electrical outlets within 6’

is a flat, finished or paved surface; no grass, gravel or dirt/sand

is protected from extremes of rain, wind, direct sunlight, and temperatures below 60° F & above 90° F. Our equipment will not function properly due to excessive heat or moisture, and will result in damage

If your venue is unable to comply with these specifications, we may need to move inside or may not be able to operate. If conditions change during an event that prevents safe usage of the unit or puts the attendants at risk, we will depart from the venue before the contracted time is complete, and NO refunds will be given.

DESIGN APPROVAL

Depending on package choice, LAKES REGION MIRROR ME BOOTH may create a custom print template, start animation, and/or photo strip to help complement the theme of CLIENT’S event. LAKES REGION MIRROR ME BOOTH allows for up to 2 revisions for each. After the 2nd revision, a fee of $15 per revision will be billed. 

IDLE HOURS

Idle hours can be arranged with the CLIENT at an additional cost of $100 for an idle hour or $150 for two idle hours. An example of idle hours is when the booth is booked for 4 hours, where the booth is operational from 5 pm – 6 pm and from 7 pm –10 pm. Between 6 pm – 7 pm, the booth will be idle at the CLIENT’S request. This is usually for meals, speeches or expected low usage times. This must be arranged no later than 21 days prior to the event date and will not be guaranteed if requested at the last minute. 

LAKES REGION MIRROR ME BOOTH will arrive a minimum of 60 minutes prior to the service start time and will start breaking down at the end of the contracted time. If required to arrive or depart outside of these windows, idle hours will be charged.

FUEL SURCHARGE

If the venue is further than 60 miles away, CLIENT agrees to pay a fuel surcharge of $3 per mile for any miles above the (roundtrip) limit of 120 miles.

HOLIDAY SURCHARGE

CLIENT agrees to pay a holiday surcharge of $300 per booking for events booked on Thanksgiving, Christmas Eve/Day, New Year’s Eve/Day, St Patrick’s Day, Easter, Cinco de Mayo, Mother’s Day, Memorial Day, Father’s Day, Independence Day or Labor Day. 

CHILD/REN UNDER 12

Child/ren under the age of 12 will not be permitted to use the photo booth without an adult present. The adult does not need to be in the photo with the child/ren, but the child/ren must be supervised to maintain order in and around the photo booth area.

DRESS

We plan to dress appropriately, but if you have a special request (special color/color NOT to wear), please let us know. We will do our best to accommodate your request. Each request will be dealt with on an individual basis. Some requests may incur additional costs.

DATE CHANGES & CANCELLATIONS

Any request for a date change must be made in writing at least 30 days in advance of the original event date. Change is subject to availability and execution of a new Rental Agreement & Service Contract. If there is not availability for the alternate date, the $450 retainer shall be forfeited, and the photo booth services cancelled. Any cancellation occurring less than 21 days prior to the event date shall forfeit all payments received and NO refunds will be given.

DISRUPTION/REFUSAL OF SERVICE

The CLIENTshall provide crowd control if warranted. LAKES REGION MIRROR ME BOOTHreserves the right to refuse service and/or depart from the venue before the contracted time is complete if attendants are harassed, threatened, or abused by any guests; or if the equipment is damaged. If any of these occur, NO refunds will be given.

EXTREME WEATHER

In the event weather would create hazardous road conditions or a state of emergency which would hinder LAKES REGION MIRROR ME BOOTH staff from travelling to your event safely, LAKES REGION MIRROR ME BOOTH reserves the right to cancel to reschedule a new date. CLIENT’S new date is subject to availability and the execution of a new Rental Agreement & Service Contract. Because this would be considered an act of God, CLIENT shall have 1 year from original event date to rebook. If not rebooked within a year of the original date, CLIENT shall forfeit all payments and NO refunds will be given.

This is a precautionary measure given our location is subject to extreme weather for events in the winter months. LAKES REGION MIRROR ME BOOTH will make every effort not to cancel an event and will only do so if the safety of staff is compromised.

INDEMNIFICATION

CLIENT understands and agrees to the following:

CLIENT will indemnify LAKES REGION MIRROR ME BOOTH against any and all liability related to CLIENT and CLIENT’S event, from the time of service and on into the future of CLIENT’S event

CLIENT will indemnify LAKES REGION MIRROR ME BOOTH against any and all liability associated with the use of pictures taken with the photo booth, its representatives, employees, or affiliates at CLIENT’S event

INSURANCE

Some venues require a Certificate of Insurance (COI).  Please request this at the time of booking.

LIABILITY

LAKES REGION MIRROR ME BOOTH is not responsible for lost, stolen or misplaced items.

Tips are always appreciated, but never expected.

RENTAL AGREEMENT AND SERVICE CONTRACT

A contract will be required and signed by both parties for all services to include the full, written intention of both parties during the designated service period and will supersede all other written and/or oral agreements between the parties. The contract shall not be modified, except in writing, and signed by both parties. In the event of a conflict between parties, CLIENT and LAKES REGION MIRROR ME BOOTH agree to solve any arguments via arbitration.

LAKES REGION MIRROR ME BOOTH and the content of its website lakesregionmirrormebooth.com are protected by copyright laws. All images and video are the exclusive property of Sherri Evans, Owner of LAKES REGION MIRROR ME BOOTH. Any use of the contents of the LAKES REGION MIRROR ME BOOTH website is strictly prohibited.
